Defamation Case: Rahul Gandhi Approaches Gujarat High Court Seeking Stay On Conviction

Congress leader Rahul Gandhi on Tuesday approached the Gujarat High Court to seek a stay on his conviction in the defamation case.?

Live Law reported that Rahul has approached the High Court against the April 20 order of the Surat court that rejected his plea to seek a stay on conviction.

"A criminal revision petition was moved today before the HC challenging the Surat Sessions Court April 20th order dismissing his application seeking a stay on his conviction. The matter will come up for hearing before a single judge in the due course of time," reported Live Law.

The petition is related to the conviction of Rahul in the defamation case filed over his 'Modi surname' comments. A Surat court found him guilty in March and sentenced him to two years in jail. He is currently out on bail. Following his conviction, Rahul was disqualified as a Member of Parliament as well under Representation of the People Act, 1951.

Outlook earlier reported, "Section 8 (3) of Representation of People Act, 1951 says any lawmaker sentenced to at least two years in jail remains disqualified for six years upon their release. This means that Rahul's disqualification will continue till 2031, as the six-year period will start in 2025 when his two-year sentence ends."

Congress advocate BM Mangukia confirmed to PTI that Rahul has filed an appeal in the High Court in Ahmedabad against the last week's order.?
